RIM, Apple May Be Affected by Kodak Lawsuit

Kodak EasyShare C813ROCHESTER, USAEastman Kodak Company filed a patent infringement suit early last year against RIM and Apple that are using camera enabled devices.

It has taken a year, and there are many steps left in the process, however, Kodak has won a hearing from the International Trade Commission. This step allows Kodak to present a case and have the commission determine if royalty payments should be made to Kodak or if importation of the devices should be curtailed. Payments could be in the hundreds of millions of dollars.

There is precedent, LG and Samsung settled in 2009 and 2010 for a total of US$950 million for a license fee from Kodak to continue to use the technology. The technology that needs to be licensed has to do with previewing a photo digitally. The interesting part of this is that Kodak, long known for film and print photographic products, has more than 1,000 patents that are currently being licensed to other manufacturers. Kodak itself has not been able to capitalize on its own technology.

Analyst expectations are that Kodak will accept a one time perpetual license fee for the technology, allowing the companies to continue shipping product. Kodak shares dropped, Apple and RIM share prices were virtually unaffected.
